Recently, have recd. approved I797 (H1B) sponsored from my employer ONLY for myself. I need to complete the I539 for my family members (spouse and Son), who are now in L2B visa as dependent. 1) Whether I need to fill both I -539 for myself and I-539A for my spouse and son (individually)? 2) Can I file on-line for myself and dependents? Attorney_23 Posted August 15, 2023 Report Share Posted August 15, 2023 Assuming the H1B was approved as a change of status (i.e., approved with an I-94, as opposed to being approved only for consular processing,) it generally would be permissible to file an I-539 for dependents to change to H-4 status. If filed online, a separate I-539 must be filed for each applicant. If filed using a paper I-539, the spouse can be the I-539 applicant and the child can be added on a Supplement A.
