ByteCruncher Posted August 8, 2023 Report Share Posted August 8, 2023 Hi, I had one H1B in 2008 and I lived for around 4 years 9 months. I had I-140 approved in 2011. But I moved out of the country and lived for around 12 years. Will I be eligible to apply for a new H1 (from a different employer) and how much I will get on that? 3 yrs or just 1 year and 3 months? Attorney_15 Posted August 9, 2023 Report Share Posted August 9, 2023 Generally, a person with an approved I-140 can qualify for an extension of H1B status of 3 years if the priority date is not current. However, since January 2017, the law limits this benefit, stating that if the priority date remains current for one year then this benefit is lost. Quote Link to comment
