ivrs11 Posted August 3, 2023 Report Share Posted August 3, 2023 (edited) Hi, My i-140 approved with Employer1 and I have only receipt number available with me no hard copy or soft copy. When requested through FOIA, I have received complete Form-140 thats approved by USCIS with priority date, PERM case number and all application information, but not I-140 approval copy(I-797). Now I’m with Employer2 and GC process not started yet. My 6 years cap will end in 2 years from now.Questions: 1) How can I get my i-140 approval soft copy from FOIA ? Will FOIA provide it ? 2) Can I use my i-140 receipt number( Filed by Employer1) to get H1B extension beyond 6 years cap with Employer2 ? 3) If Employer2 starts GC process will my previous priority date retained ? Attorney_16 Posted August 4, 2023 Report Share Posted August 4, 2023 Generally you will not get an I-140 approval notice through FOIA as those are computer generated. If you have the copy of the I-140 that is stamped by USCIS as approved (and you know the I-140 hasnt been withdrawn within 180 days of approval), you can use it to extend your H1B status. You can also use a retained priority date from that petition. Quote Link to comment
