enjoy007 Posted August 1, 2023 Report Share Posted August 1, 2023 We are in a unique situation. applied for H1+ h4 +H4 EAD in April at Nebraska Service center. in july, upgraded to premium and H1 is approved but still waiting for H4 + H4 EAD Approval. EAD Expires on Aug 2nd and will be placed under leave of absence by the company and we have travel plans to India on Aug 12. 1) if we don't get EAD Card but only get H4 approval before Aug 12 and get I-9 Verified before 12, under the new rule EAD Auto extension can be done for 180 Days with valid I94 . So in this case, can we continue working until the EAD Card arrives in this case does I 94 is valid which we got via H4 approval or does it go void and will be valid after we come back to states after visa stamping and new I94 at port of entry. 2) Can we get I9 Verified in India after the EAD card receives in mail after we go to India.
