Attorney_15 Posted July 24, 2023 Report Share Posted July 24, 2023 Over the past year+ USCIS has been issuing Notice of Intent to Revoke and Revocations in cases where the agency is saying that someone had an unfair advantage. It seems that in many of these NOIRs, USCIS is quoting from a posting on USCIS.gov's page: H-1B Electronic Registration Process, under "Unfairly Increasing Chances of Selection." But there seems that there might be a flaw in these NOIRs and Revocations. Specifically, what seems to be happening is that USCIS revokes an H1B when two things: (1) different companies that are each fully owned by different people (even though the owners of different companies might be related) and (2) each of these companies only submitted one registration for the person. This is a legally faulty reasoning. Is anybody seeing responses to these NOIRs and Revocations leading to Reaffirmation of the H1B Approval? What kind of arguments are being successful?
