Aravind Nunna Posted July 13, 2023 Report Posted July 13, 2023 USCIS has requested to prove that the beneficiary is qualified to perform services in the specialty occupation. Beneficiary has obtained master’s in computer science by Monroe College, New York, USA which is field directly meets the criteria to perform services in a Specialty Occupation position of a Software Quality Assurance Analysts and Testers with SOC Code -15-1253.00. But the USCIS quoted that Monroe College does not meet the definition of a US Institute of higher education under 20 USC § 1001(a) stating that Monroe College is private for-profit institution. However, Monroe College is private for-profit institution and also Accredited College in US as per U.S. Department of Education. Though Monroe College is a private for-profit institution, Beneficiaries US master’s degree in computer science is still valid which states that Beneficiary is well qualified to hold the specialty occupation position. Any idea How to reply this ? Quote

However, what is the necessary documentation to fully responds to such an RFE really requires the careful review of the request by an attorney. Quote
