Is it possible to file two different PERMS for the same employee and by the same employer for two different positions, when the first one is still in pending state? My PERM was filed on Nov 2010 and I received an audit on Dec 2010. My employer replied to the audit in Jan 2011 and we are still waiting. My original PERM was filed in EB-3. My attorney/employer have decided to file a new PERM in EB-2 while the first one is still pending. Please let me know if this is possible. Also I am on 6th year of my H-1 which expires in Dec 2011.
