In 5th year H1-B and Change jobs

Case: Currently on H1b, 5th year and am looking to change jobs

- I-140 Pending with PD of Sep 2010 from current employer

- EB3 India case with PDs not being current

- Currently in 5th year of H1.. 6th year expires in Nov 2012

- Current company have filed for H1-B extension taking me to my 6th year ie Nov 2012.

Question:

1. Can I change jobs in 5th year with pending H1-B extnsion and I-140 pending ?

2. Do I need to file for the new PERM before Nov 2011 (i.e. 365 days before my 6 years expire) or if I get a 3 year extension, I will have more time.

3. Do company usually file for PERM as soon as you join the company ?

applying LC depends on company policy, but any legitimate company would want to see their employee's performance before deciding to petition their employee.
