daydreaming1 Posted June 2, 2011 Report Share Posted June 2, 2011 my I-140 was applied under eb1c at TSC in Oct-2010 and is still pending. my 7 years in L1A will complete in Dec-2012. My 6 years stay in USA will end in Dec-2011. i am finding better career options with other employers but, i am running out of options because of my immigration situation. i have the following querries-- 1) if I switch now, it is my understanding that the new employer will be able to file for a new H1B but, that will be valid only till Dec-2011 (end of my 6 years stay in USA). how will i extend my H1B beyond Dec-2011 2) if I stay on with the current employer, hoping to get the I-140 approved soon but, I-140 still remains unapproved. In this case, if I switch in Jan-2012, how will my new employer be able to file for a new H1B because by Dec-2011 my 6 years stay in USA will complete and i will neither have the case of PERM filed by the end of 5 years on H1B nor the I-140 approved to support the H1B approval beyond 6 years please suggest some options if any available to me Link to comment
