CanInd123 Posted June 15, 2023 Report Share Posted June 15, 2023 Hi, I am a Canadian Citizen (Naturalized) and currently employed in the US on L1 visa. My GC processing in progress with I140 approved and I485 in progress. Due to some personal circumstances, I am spending a lot of time in Canada and working remotely and travelling to US once in a month. I have to continue this for 2-3 months more before permanently settling back in the US. I would like to know if these frequent travels and prolonged stays outside US would impact my I485 processing. As per some law firm websites, L1 doesn't have any location restrictions. USCIS support confirmed that My I485 has been transferred to a local FO and I would have to attend an interview in the final stages of my I485 processing. I am suspecting the interview was not waived considering my travel. Please advise if it's risky to continue with I485 or shall I withdraw it and apply again after a few months. Quote Link to comment
Attorney_20 Posted August 31, 2023 Report Share Posted August 31, 2023 It's okay to be outside the U.S. while the I-485 is pending as long as you have Advanced Parole to return to the U.S. Without Advanced Parole, you may abandon your I-485 application. Once the I-485 is approved, you will need to establish permanent residence in the U.S. Quote Link to comment
