Hello,

I was in L1 visa for 7 years and my GC petition was filed by my employer. Now I am in H4 and continuing with the same employer.

With H4 EAD status, can I switch the employer by retaining the current GC petition? In other words, what I should do to switch to a different company and retain the current GC priority date?

Thanks for your help

An EAD is not employer specific and can be used for any employer, but sponsor you for a green card, a new employer would need to start a new PERM and file a new I-140 petition. The priority date from a prior approved I-140 petition can generally be retained unless the petition was withdrawn within 180 days of the approval by the employer or if the I-140 petition is otherwise invalidated.
