Currently I live/work in US in TN visa and my kids live in Canada I am planning to move them in US once I am ready to apply for I-140 i.e. immediately after PERM approval. Attorney_17 Posted June 12, 2023 Report Share Posted June 12, 2023 Hello, An I-140 does not provide status, so the 90 day rule is inapplicable in this situation. A TN holder may bring their spouse and children to the US in TD status (TN dependent status). This would allow them to live with you in the US. However, this status does not permit employment, though it does allow for study. Quote Link to comment
