My Question is " Is it possible to transfer the rejected H1b to another employer to avoid the lottery participation again? Quote Link to comment
Attorney_26 Posted July 25, 2023 Report Share Posted July 25, 2023 If, as a result of the 221(g) visa denial, the H1b petition is revoked by USCIS for fraud or misrepresentation, then you will need to go through the lottery process again. The reason for the visa denial is critical. Highly recommend that you consult with an experienced immigration attorney. Quote Link to comment
