pila Posted May 15, 2023 Report Posted May 15, 2023 (edited) Team, My employer A initiated my GC and submitted PERM with priority date as 2013 November and that got approved after an year. Due to some other reasons I left the company and moved to Company B. They submitted new PERM immediately with priority date as 2015 June and I have a valid I-140 with that company. Now, I moved to company C and they initiated my GC process with priority dates as 2015 June. I heard from my friends, that there is a possibility that I can use my 2013 approved PERM date. Can you help me to understand what is the possibility for this. My question here is, can I recapture my 2013 Nov priority date with a new employer ? Attorney_15 Posted July 5, 2023 Report Posted July 5, 2023 Under the law, a priority date is only established when the I-140 Petition is approved. If a PERM is filed and approved but no I-140 filed, then there is no priority date created in that instance. Quote
