Narig Posted March 28, 2023 Report Share Posted March 28, 2023 Our company has offices in different locations , My PERM and i140 is approved (PD is 2018)for one location in X state , I would like to move to different state Y .There no change in job roles/duties. Do we need to redo PERM and I140 ? I’m will to come back and work from location X once my I485 is filed. please advise . Thank you . Quote Link to comment
InExcile Posted April 13, 2023 Report Share Posted April 13, 2023 You have 3 options. 1. Redo PERM and I-140 for new location 2. Wait until I-485 is filed. If I-485 is pending for more than 180 days, use AC-21 Job Portability provision. I.e., submit a new I-485J for new location/position 3. Wait until you get Green card (I-485 approval). Then move back to original PERM location for a period of at least 6 months (consult with your immigration lawyer for time-frame) I personally was waiting for option 2, but I-485 was approved in 60 days. Didn't qualify for AC-21 and then ended up going with Option 3. Quote Link to comment
