MD1
Hi, My company had recently filed for bankruptcy and put all of its employees in furlough for 1-2 months without any pay and looking for external options to continue its operations. I'm on H1b visa and say In my case as per my LCA the min wage is 80K and max wage is 120K (annual) and my salary is 100K. My company had not revoked any of our H1b's as they are negotiations being done to continue its operation in next 30 days. As I'm not getting paid currently - Am I out of status right-away or do I have couple of months based on the LCA. I'm currently looking for new opportunities but as its time sensitive would like to know the answer for the above question. Thank you Quote Link to comment
whiskeyjack
Not sure if the 60 days grace period apply to you, but if you can find a job pretty fast and ask them to apply a transfer, most likely you will be fine Quote Link to comment
LeaveMessageH1B
H1B can not be furlough, not getting paid is violation of LCA conditions regardless of reasons. Start ASAP to look for an employer who can transfer your H1b. Quote Link to comment
