I have applied for new H4 EAD on 02/22/23.(My spouse have approved I-140) I am currently working on basis of L2 EAD,My company’s attorney is saying I am allowed to work based on the 540 days auto extension rule. Attorney_10 Posted March 10, 2023 Report Share Posted March 10, 2023 Although H-4 spouses may be eligible for an automatic extension of an Employment Authorization Document (EAD), automatic extension is only available when the EAD renewal is based on the same employment authorization category as the expiring EAD. Therefore, automatic extension is not available for applicants with expiring EADs based on an underlying L-2 status who are now applying for new EADs based on an underlying H-4 status. Every case is different.
