Do my company need to process my perm labor again if I move from the current location to a different location ? Attorney_10 Posted February 23 Report Share Posted February 23 Generally, the PERM process is location specific so if the worksite changes to an area outside of normal commuting distance from the worksite listed on the ETA Form 9089 then a new Labor Certification must be filed. This also applies to a position which changes to a telecommuting position from an in-person position if such an option was not available on the original Labor Certification. However, if your I-140 is approved you can retain your original priority date after your company obtains a new Labor Certification and files a new I-140 on your behalf. Every case is different.
