con_air Posted August 8, 2011 Report Posted August 8, 2011 Hi, Below is my case: I went for H1b visa interview to Kolkata consulate, at the time of interview VO took my documents (I797, I129, LCA, etc). After few days my visa was approved, and I went to Kolkata consulate to submit my passport. I received only my passport few days later with H1b visa stamp. However I did not receive my original I797, and other docs which the Visa Officer took at the visa interview. I believe the original I797 is needed at the port of entry.... Please send your thoughts on my situation

The best bet would be if you can mail the consulate about missing i797 and take the printout of that mail and a printout of photocopy of approved I797 (If you have one) and travel. You may need approved I797 at some point of time so better to check about it with consulate.
con_air Posted August 15, 2011 Author Report Posted August 15, 2011 @sanjivvinaik: Yes I do have the photocopy of I797 and have sent a mail to kolkata consulate to send me the original document, The consular replied back saying that they are in the process of mailing my documents 10 days back but I did not receive the documents yet
leo_maverick Posted August 15, 2011 Report Posted August 15, 2011 Same thing happened to one of my buddy, he carried phtocopy of I-797 but luckily he was not asked to show his I-797 at the port of entry. Remember in order to get the duplicate I-797 from USCIS it takes about 2-3 months, so better check with your attorney whether he have copy of it? Good luck!

If the doc reached you before you fly to US then great else you can take the printout of your mail and consulte reply along with the photocopy of I797 and als omail yoursekf a copy of it (keep that in your email) nad travel. If office ask you @ POE then you show and enter and once you are in Us then can ask your attorney go get a duplicate copy.
