jazzonazz Posted June 17, 2011 Report Share Posted June 17, 2011 Hello all, Thank you all in advance for your input, I have agreed with my employer to opt for the CP process from the beginning of the procedure. My I-140 has been approved, but the text reads : "the petition indicates that the person for whom your are petitioning is in the US and will apply for AOS ..." That confused me knowing that we opted for CP before the approval of the I-140. My Question is, do all I-140's read the same content, or it should have indicated in the text that I am opting for CP ? Joe.F Posted June 17, 2011 Report Share Posted June 17, 2011 The request to do CP has to be marked on the I-140. Check with the lawyer if that happened. If not, you'd have to file an I-824 to change to CP. Link to comment
jazzonazz Posted June 22, 2011 Author Report Share Posted June 22, 2011 Hello, Thank you for your reply, I notified my employer of the mistake, they said they called the lawyer and he said 'good catch’, funny when you are sitting waiting on the other half of the globe for a slight possibility of having a better life. Regardless, he told my employer he called USCIS by phone to rectify the error, I Am not a legally trained person, so I don’t know if its possible, I though that even for mistakes commit by USCIS itself, we all need to go through the I-824 to rectify errors, So my question, can you really just call USCIS and tell them to rectify an error? My understanding is that he wants to go for CP (or has to, if he is abroad.) I don't know if a lawyer can fix that with a phone call. Normally, filing form I-824 is required. Link to comment
jazzonazz Posted June 23, 2011 Author Report Share Posted June 23, 2011 Thank you both, Yes I want to go through CP not AOS, The lawyer said he called by phone and corrected, which I find hard to believe, and he is not answering when I ask him if He filed I-824 , can he file it without my signature ?
