Reddy1981 Posted April 26, 2011 Report Share Posted April 26, 2011 Hello, I have recently transferred to a new employer. They have applied for my H1 and it was approved till July 2013. My H1 (and my wifes H4) approval from the previous employer was valid till June 2013. Do I (or my new company) need to apply for any change for my wife or she can continue to stay on the same H4 from my previous company. When she visits India, she will need to go for visa stamping as both our visas have expired in May 2009. Can she visit the consulate with my new H1 approval or does she need any separate petition? Basically our HR is saying the company lawyer does not need to do anything for the H4. I just want to make sure that my wife is in status and that we can get the visa stamp for H4 when we go to India. Thanks in advance, Reddy Link to comment
rajorshic Posted May 4, 2011 Report Share Posted May 4, 2011 H4 visa is granted on the basis of your H1 eligibility. It does not depend on your employer. So you are good and do not need to do anything for your wife's H4 as long as her I 94 has the same expiry date as yours. Link to comment
