Nunc Pro Tunc - Works!!!

Here is my case -

Jul 2010 - Visited india and came back to the US , I 94 card stamped with the passport expiry date ( Jan 2011 ).

Sept 2010 - US visa expired.

Jan 2011 - Passport expired.

H1 B Petition - Valid till Nov 2012.

April - Discovered my I 94 expired and i am out of status for more than 3 months. Remember more than 180 days, is a very dangerous situation and never let that happen.

Border Patrol can/will validate if one reaches them before the expiry date on I 94,some cases are accepted even after a month of the expired date. They do have the authority to reinstate but its at their dicretion.

Rentering the US - is not a economically viable option for some of us.

Infopass USCIS - Will not work.

What will surely work is Attorney + Nunc Pro Tunc.I got my I 94 revalidated to the dates.
