H1B NOID Posted September 11, 2022 Report Share Posted September 11, 2022 H1B Application Reached USCIS on 30th August, 2022 Applicant due to Medical Emergency had to leave for India on 29th July, 2022 (Date captured on Travel History) Received NOID Notice dated September 6th as beneficiary was not in US while filing for the application and requested as below: Please note that the issued in question is the requested action of extending the beneficiary stay in the US. If you are unable to provide evidence that the beneficiary was in US at the time of filing, the classification portion of the petition may be approved, and the beneficiary may apply for visa abroad. Please suggest if we can update the classification in I-129 form and resend the application as a response to this NOID or will have to file for application again with new filing fees Quote Link to comment
