unlawfully present, overstayed

Have you ever been unlawfully present, overstayed the amount of time granted by an immigration official or otherwise violated the terms of a U.S. visa?

I am applying for visitor visa for my daughter’s marriage. What should be my answer to above question in view of the following situation;

I entered US on H1Bin Dec 1998. The Green Card was filed (I485 was filed). I continued on H1B. The H1B extension for 7th years was not approved. Appeal was filed but it was also not approved. After 5-6 days I received my EAD and started  working.

Finally in June 2009 my Green Card was denied because of the above gap of 5-6 days.  Appeal was filed. I returned to India on 2 Dec 2009. Later I got the information that the appeal was also denied.

Please help.

Thanks and Regards
