JobSeeker29 Posted October 25, 2021 Report Share Posted October 25, 2021 My husband's I797 validity expiry is in Jan 2022 and he had to travel urgently to India on 23rd Oct 2021. Considering there are no available appointments for Nov, Dec 2021, if he gets an appointment in Dec 2021/ Jan 2022, is there a chance that it might not get stamped because of only a month or less remaining in the validity period. Please note that his visa renewal petition is still in "case received" with the USCIS. Waiting for the new I797 might take months. Please provide guidance on what can be done here?
