Can a new employer transfer the same H1 if I get a job now or do they need to file a complete new H1b going in the lottery again? Quote Link to comment
JoeF Posted September 2, 2021 Report Share Posted September 2, 2021 H1 revocation happens when you leave the H1 job. The employer has to inform USCIS that you no longer work there, and USCIS then revokes the H1. It has no effect on you nor on the ability to get a new cap-exempt H1 if you haven't used the full 6 years. So, a new employer can file an H1 petition for you at any time, and when it is approved you can start working for the employer. Quote Link to comment
