Porting and interfiling letter.

Hello ALl,

My EB2 I140 got approved with new PD. Porting is not done. Not submitted porting letter.

Last week my EB2 140 is approved by TSC.

In 2005 EB3 I140 is approved at CSC after taht I am not sure where it is now.

I485 is moved from CSC to NSC.

Received RFE on 485 in 2007 submitted evidences and status is showing as reviewing evidences

I am quite confused on

To which USCIS center I need to submit Porting request letter?

and also

Can I submit both porting request and interfiling request in one request? or should send one by one.

Please advice.

porting - request to port priority date from EB3 I140 to EB2 I140

and

interfiling - Request to approve already filed 485 based on new EB2 I140.

Am I wrong?

Since your PD has already been assigned to your I-485 case, I am not sure there is a true need to "port" or retain your PD. Your goal should be to interfile the new I-140 with the pedning I-485. Since unsolicited communication does not get far in the USCIS, I would start with understanding if you have been assigned two A numbers. If so, you need to make a service request to merge these numbers. That should automatically interfile your petitions.

In my opinion, PD is not really relevant here, since you already have I-485 pending, and it is already assigned an earlier PD. You can take an InfoPass and check if your I-485 is connected to the newly approved I-140.

Hi kpallir,

I'm in the same boat as you. My EB3 PD is 2003 July. Recently got EB2-I140 approved with July 2010 PD. A# is same on both I-140's. My lawyer has sent a letter to CIS to port the PD. Any further updates on your case? I'll be posting updates on my case as they happen.
