Ak C Posted February 21, 2021 Report Share Posted February 21, 2021 Hi, I have H4 visa valid till June2022. I have filed H4 EAD in Jan 2021 to texas office so expecting approval by Oct 2021. Question is, what will happen to my H4EAD application if my spouse on H1B changes employer in July 2021 ( assuming current employer will not revoke i140) Thank you in advance for your response! nvragn Posted March 5, 2021 Report Share Posted March 5, 2021 You will possibly get an RFE first to get the new approved H1B of your spouse. I have a similar situation and that is what my lawyer said. Once you get the new approved H1B, you can send out an email through online portal providing details of approval. What I heard that we can not send any extra documents to USCIS when the application is in progress unless USCIS asks . That ask can be in the form of RFE as you said. Were you able to send the new H1b document to USCIS without RFE? Also did you receive H4 EAD now? If yes, then the validity is per new h1b end date or old h1b end date? Quote Link to comment
