Is there a way I can find out if my lawyer and employer are filing my I-140 in EB2 or EB3 from ETA Form 9089? Link to comment
Attorney_19 Posted June 3, 2011 Report Share Posted June 3, 2011 The minimum education and experience requirements on the Form 9089 will determine if the I-140 petition will be for EB2 or EB3. Generally (with some exceptions) if the PERM labor certification (LC) requires a person with a Masters degree or higher, it will be EB2. If the LC requires a Bachelors plus 5 years of post-Bachelors work experience, it will probably be EB2. Link to comment
