(It is same employer through out my GC process) - Current H1B approved till July 2023 - EB2 I140 approved with priority date Sept 2013 - I will soon file EB-3 downgrade with concurrent I-485, EAD and AP, assume that before 31st Oct 2020, my concurrent filing is done. - Assume that in 8 months, I am getting my EB3 I-140, EAD and AP approved (I-485 is still pending). Scenario :- Now let us say, after 1 year, EB3 retrogress and EB-2 moving faster and I want to go back to EB-2 Queue. I heard something like "Inter-filing" but it does not clearly answer below points. Question :- Does it need a new PERM ? - Does it need a new EB2 I140 ? (or I can use the previous one which is still active) ? - and most important point, does it need a new I-485 ? (because the I-485, which is pending currently is based of EB3 I-140). Basically, trying to know exact procedure and sequence to go back to EB2 queue. Quote Link to comment
