pacificjak Posted October 3, 2020 Report Share Posted October 3, 2020 I worked for company A in year 2012,2013,2014 , they filed PERM in Aug 2012 and I have approved I-140 EB2 from them . I moved to Company B in Year 2014 .The company A doesn't have sufficient funds / Profit/ asset to satisfy the Ability to pay clause from the day original PERM was filed up-to now to file downgraded I-140 EB3 . 1: What other options company can avail . Does a Line of Credit from Bank equivalent to the deficit can help us in Downgrade process. 2: If tomorrow the EB2 date becomes current for me and I am eligible to file I-485 , do the USCIS check Ability to pay again at the I-485 stage.
