Rajarajesh
Hello friends, As you all know, after last visa bulletin with big leap in dates every one wants to go forward and downgrade from EB2 to EB3 who has current date. I am also one of them. I just want to know, as I am healthcare worker and my first employer A filed EB2 and I got approved I 140. Now I am with employer B and I transferred my EB 2 with old priority date. 1) Company told me you may have schedule A (without PERM) eb2 so it is not safe to downgrade to EB3. Why is it risky? 2) As I was in process of first time filing I think my first company had filed PERM and I am not Schedule A. Can I check anywhere online that do I have previously filed PERM? 3) As some one told me that it is risky to downgrade if your initial i140 not filed by your same employer. Is it true and how? Thank you. Rajesh. Quote Link to comment
