I moved to Canada and working for the same company X but as Canadian employee. Can my company apply for 485 if my filing date is current if I am not on H1B anymore? At what point in the process I should be on H1b again or Can I get my GC even if I do not have H1B ( Assuming my company is willing to do all the process for GC) Thanks a lot in advance. Quote

CottenSch Posted January 16, 2021 Report Posted January 16, 2021 (edited) One thing you need to keep in mind too that there's a maximum 60-day grace period in which to find a new job and have another employer submit an H-1B petition for you to allow you to remain in the United States.
