Balaji Baskaran
Hi, I am on H1B visa got I-140 already approved under EB1-C category. With the recent movements in Final action dates for EB1 as per visa bulletin, my priority date is becoming eligible to file I-485 in September. My employer attempted to file a H1B to L1A conversion last year and it got denied by USCIS. Eventually employer filed for H1B extension and that has been approved by USCIS. Below are my questions: 1. Does the denial of H1B to L1A conversion in any way affect my subsequent Green Card processing? (I485 filing) 2. Are there any concerns in filing I485 under EB1C since I am on H1B visa? Since my EB1C is approved while I was on H1B visa, can I assume that my case is good to move forward for I-485 filing when the priority date becomes current? Please advise. Thanks, Balaji Quote Link to comment
