utmba2001 Posted August 8, 2020 Report Posted August 8, 2020 Hello Murthy law firm volunteers: My fiancee and I are planning to get married in 2021. She is currently a student in a university. After our marriage next year, I intend to file for her green card under the spousal category (and yes I am a naturalized US Citizen). I also intend to add her 2 kids (14 and 16 years old) to the green card application. While my fiancee will finish her education and start working in the US in 2022, the kids intend to finish high school in India and then move to the US in 2023. Under these circumstances, the children will get their green card when they are still finishing their education in India. My question relates to the residency requirement for the kids. They may spend 2-3 months in the US, but will travel back to India for their high school education. Do you foresee any issues/concerns for them to maintain their green card while studying in India?
