kunjdab Posted June 23, 2020 Report Posted June 23, 2020 I've a valid approved I-797 until 2023, but an expired Visa Stamp ( expired March of this year). I need to travel to India because of an emergency and because of the consulates being closed, will not be able to get a visa stamp. Can I show my approved I-797 when I return? Does the new travel ban restrict my travel back? Thanks for your time. Quote
cap-gap Posted June 25, 2020 Report Posted June 25, 2020 The new h1b ban will prevent you from even getting a stamp.. but don’t let immigration matters control your decisions on urgent matters related to life or family.. there will be lot of regrets.. Quote
User099 Posted June 25, 2020 Report Posted June 25, 2020 You need a valid visa to travel back. You will not be able to come back with the travel ban even if you get a visa now. Quote
pappu2003 Posted June 25, 2020 Report Posted June 25, 2020 Technically, you are exempt from the ban, because you ARE IN US when the proclamation was announced. (Obviously talk to a lawyer). They may decide to let you get your visa stamped. That was what I took away from **** *******. Quote
