myb Posted May 10, 2020 Report Share Posted May 10, 2020 I have an approved I-140 with a priority date of 24-Jan-2011 (EB3 India) through my first employer. That I-140 was used by my second (current) employer to port the priority date. My new I-140 with current employer was approved recently on 03-Mar-2020. Now due to pandemic, if I loose my job and my current employer withdraws I-140 (before 180 days), can I use my old I-140 to find a new job with new a employer and get 3 year extension based on the fact that my priority date is not current? Does old I-140 from the first employer remain valid even if the new one (which was used to port the priority date) is revoked?PS. My current H-1B with current employer is valid until 28-Aug-2021.I really appreciate your expert advice in this scenario. Quote Link to comment
