sri909 Posted March 17, 2020 Report Share Posted March 17, 2020 Hi team, My mom travelled to USA in Oct 2019 and she got her i-94 valid to oct 2020. As per the visitor visa she has to leave the counry within 6 months, due to conrona virus we would like extend her stay. My Question is since she has her i-94 valid till one year , can she stay for few more months or should i file i-539 to extend her stay. Please suggest folks. Thanks Sri Quote Link to comment

In general, one is given an i-94 valid for 6 months at the time of entry into the U.S. I-94 for 1 year is not very common. It is best to have this double-checked. If your mother is already in the U.S. for a year by October, 2020, if the travel restrictions are removed, it may be best for her to return to India. If she needs to stay beyond this, then an extension should be filed during the validity of current I-94. Quote Link to comment
