sravik Posted March 12, 2020 Report Share Posted March 12, 2020 Hi, I had applied for my I-140 in regular processing around Jun 2018 with my previous employer and its still pending as of March 2020. Meanwhile I transitioned to a new employer in Jun 2019. However my previous employer has agreed to keep the I-140 petition as filed. I am trying to initiate conversations with my new employer and since my I-140 is still pending from my previous employer. Is there any way that i could retain my priority date when the new employer initiates the GC process and is it required for the new employer to do the PERM processing again? JoeF Posted March 13, 2020 Report Share Posted March 13, 2020 The new employer always has to start the GC process from scratch, with PERM. That is true even if you could keep the PD. You can only keep the PD if you have an approved I-140. Quote Link to comment
