Ch2453
My h1b approved . Sevis has also been terminated as per what college dso said. but today my employer received i797 c saying worker is ineligible for change of status and may depart usa and get visa stamped at consulate mentioned in the notice. How many days can i stay in usa ? Can i work now ? Should i request a data fix in my college and then go to india ? Can i go to stamping with i797 c . Or should wait for the official notice ? User099
If your COS is denied, you can request for a datafix by your DSO and work on OPT. Or else you can go for stamping with the I797 and come back with the visa. If you are not going for the datafix, you will have to leave ASAP. Quote Link to comment

User099
Your employer or attorney might have received the I797B. Check with them. Quote Link to comment
Akhil Rachamalla
I'm in the same situation if we fix the data issue in university does our H1 gets canceled or will it stay as same then activate after getting stamped ? Quote Link to comment
User099
Data fix will not have impact on the H1. But its better to go for stamping ASAP. Quote Link to comment
