pt6992
Hi Guys, Here's my case 1. Maxed out my H1b on 10/01/2016 2. By that time I got my I-140 approved with previous employer (Receipt date: 07/20/2016) 3. Changed my job and filed for H1B extension & ported PD to fresh I-140 (Receipt date: 07/17/2018) 4. Moved out of country on 07/01/2019 (Had valid H1 until 10/01/2019) 5. My company didn't file for H1B extension as they were planning to bring me on L visa. Is this a blunder ? Question 1. Am I still eligible for CAP exempt H1B filing with the same employer (I am still working for same employer in India)? 2. If no, do I have to wait for another one year? Can I apply for 2020 filing?
