pawansagar2000 Posted December 31, 2019 Report Share Posted December 31, 2019 My I797 has an expiration date of 1/14/2020, where as my I94 has been stamped until 1/24/2020. What is the deadline date by which I need to have a H1B extension receipt number in order to be able to stay in US lawfully until the petition is approved or denied? Is it 1/14 or 1/24? pawansagar2000 Posted January 9, 2020 Author Report Share Posted January 9, 2020 On further checking with a couple of lawyers, both mentioned that my I94 date is what would determine my payroll as well as the deadline for me to submit my H1B extension. Both lawyers, in seperate consultations, mentioned that I797 is a document which only lets you enter the US and beyond that your legal stay is covered by I94. So, even though my I797 expires on 1/14 but since my I94 is valid until 1/24, not only can my payroll run until 1/24, but my extension filing deadline is also 1/24. Quote Link to comment
