H1B transfer after I-140 approval

Hi,

I am currently working for company A and have I-140 approved 2 years back. My H1b renewal is due end of this year and is in process.

I also applied for H4 EAD renewal and is in process. I intend to switch to company B. Company B will be applying premium processing for H1b visa transfer.I have below questions:

1. If I receive RFE on the visa renewal from company A will it impact processing for company B?

2. How can I get H4 EAD renewed for my spouse when switching job in this scenario?

1. Most likely not, if you have a valid I94 while B is filing for the transfer.

2. You can use the I797 approval copy from B and apply for H4 and H4 EAD renewal. H4 and H4 EAD extensions can be filed along with your transfer application to Company B.
