Then, my employer, Deloitte, applied for an LCA, which caused my expiration date to be pulled back to December 2019. Next, Deloitte applied for an extension, which got an RFE. If I receive a denial, do I have to leave immediately or can I have my H1B transferred to a different employer? Quote Link to comment
care_candidate Posted October 23, 2019 Report Share Posted October 23, 2019 What is the reason for them pulling back your H1b to Dec 2019? Filing LCA should not have effect on ongoing approval. Anytime you are out of status, you need to leave immediately. Quote Link to comment

Something is not adding up in this statement. Lets assume your current status ends in Dec 2019 and your Extension is denied before then, you will need to apply for a transfer before Dec 2019. If you are extension is denied after Dec 2019, you will have to leave immediately. Quote Link to comment
