Does EB2 experience requirement discount work experience gained under current employer?

I have 2 years and 10 months of work experience prior to my master's degree. After graduating I was hired by my employer where I have been working for the past 5+ years under F1 and H1B later. So a total of 8 years. My employer/attorney says I do not qualify for Eb2 master's + 3 years requirement. I find this weird. Can anybody verify the claim? Is it a hard and fact rule with the DOL?
