Neo0422
Recently last week I was arrested for DUI (Was sleeping in the car in parking lot ) and was charged with 2 other Felony charges, I have a hired a criminal lawyer, and will be having the hearing soon, Now I am on F-1 OPT STEM working and I got my H1B approved the next day of arrest(I am so unfortunate). After discussing with the Attorney, what he says is, we may get the felony charges dropped and convict to some misdemeanor, My Question is if at all we are able to achieve this, Will I get H1b stamping done? I know the current situations are really bad, and I so regret sleeping in the car (Rather would have slept in the restaurant). Will (if) the felony charges are dismissed or dropped, will it still make me inadmissible to USA? or I will get a 221g as the felony charges nor the misdemeanor charge come under inadmissibility. Please everyone I really need your help, This is just the start of my career in USA and I know I have made a huge mistake, I cannot afford losing my ability to work in The US. Please someone please help me..!! Quote Link to comment
MurthyIndia_Lawyer
Given your background, it is best to consult an experienced immigration attorney to understand the potential risks involved in your visa stamping. You need to analyze if you have triggered any inadmissibility (bar to re-enter the U.S.) based on your arrest. If yes, then you need to understand the options available for you. Quote Link to comment
