L1b Visa Fees & L1B to H4

Hello,

I am currently working on L1B visa which expires in October 2019 and needs to be renewed before that. My employer has now refused to pay any visa related fees including the legal fees. 

1. Is it legal to deny to pay the fees?

2. What action should/can I take in this matter? 

My husband had H1b visa with I140 filed for. Assuming I get the H4 visa and I140 approval still pending, can I apply for H4 EAD?
