nainsij Posted July 12, 2019 Report Share Posted July 12, 2019 Hi everyone, I am working as full-time Intern on F1-CPT with a Fortune 500 company. I received my H1b visa approval last week but my employer can't extend my internship beyond July 30th due to some company policies. They are ready to give me an offer letter for another position on different subsidiary starting from October 1st 2019. My H1b was filed under Consular Processing and hence I need to go to India for visa stamping. Can anyone suggest me what should I do in this situation? Can I apply for H1b visa stamping on behalf of offer letter if I will not work for next two months? Link to comment
JoeF Posted July 12, 2019 Report Share Posted July 12, 2019 You can only get an H1 if the original position continues to exist until you start on the H1. A different position means the H1 is gone. And you'll likely have problems due to the CPT, anyway. That's a big red flag nowadays. Link to comment
