Nile284 Posted July 10, 2019 Report Share Posted July 10, 2019 My employer filled a change of status for me from L1A to H1B as I am closing in on my max out date. The GC process for me has also been initiated under EB-1 and I 140 has been approved in June 2018. Currently my employer is waiting on visa bulletin to get a current status to file I 485. My COS was approved effective April 2019. Concurrently the employer filled for my wife's H4 which was approved effective June 2019. My wife has a valid L2 EAD and is currently working. Unfortunately my employer did not concurrently file H4 EAD for my wife, which they have initiated only recently. In such situation can my wife continue to work for her current employer on L2 EAD which is set to expire in November 2019? Can she change her current job and join a new Company under L2 EAD? Since her H4 is approved does she have to quit her current job and take break? Link to comment
JoeF Posted July 11, 2019 Report Share Posted July 11, 2019 Her EAD became invalid the moment the H4 was approved. She needs to stop working immediately. She can only start working again when her H4 EAD is approved. Link to comment
