H1B Stamping after DUI ==> Wet reckless ==> RFE

Recommended Posts

Hello Everyone,

Just like many people here, I have been arrested for DUI with BAC 0.10/0.11 in April 2018. My attorney made a deal with DA and my charges were reduced to "Wet Reckless" with 3 months of DUI class, fine, and 1 session of MADD and 3 years of probation.
My background:
When I arrested I was on OPT and currently I am on STEM OPT.
My H1B is approved but its a consular application, So my lawyer applied for H1B amendment for change of status and got RFE, the detail of RFE will in the later part.  F1 visa is revoked after the arrest.

RFE:
They want to have signed consent from me to inform my employer regarding current inadmissibility to the states.

I am going for my first H1B stamping now and I have following questions:
1. For the RFE I have three options: 1. Withdraw my application 2. Provide a consent (Not recommended by my company's attorney) 3. Adjudicate without my consent (Most likely denial, but may be they can revoke my already approved consular application too unlikely.)
2. What is the process for stamping and how many weeks should I plan?
3. While visa interview what documents of arrest should I submit? (Do I need to submit the police report too with all other court documents)
4.  What to explain in interview?
5.  What to write in DS160?
6. Is it ok to go for stamping while on probation (I don't have much choice though)

I would appreciate any help with the questions. I know this is a painful process and not worth it so DON'T DRINK AND DRIVE.

Thanks.

@Ahaan

Where are you currently? US or outside US? Your RFE sounds unique to me , never heard about it before. what is the consent you've to sign? Looks like you already informed your employer , then why do u need to sign it? Your case sounds very confusing , Please consult a competent immigration lawyer other than the one provided by your employer
